Acceptance of all Terms and Conditions and Acknowledgement of Rockwire Waiver
On behalf of my business/company/school, I have read, understood and accept all of the information, processes, pricing, terms, and conditions included in the Rockwire Waiver, and I confirm receipt and acceptance of the RockWire Mt Buller Pty. Ltd. waiver (i.e. the exclusion of liability and waiver of right to sue), and confirm I will commit to the following terms and conditions:
1. All Recreational Services are subject to availability.
2. Recreational Services are confirmed at the time of booking. Recreational Services remain subject to change and will be re-confirmed prior to the group’s arrival by the coordinator, teacher or assistant.
3. Recreational Services changes will not be accepted within ten (10) days prior to the group’s arrival.
4. Recreational Services are only available to groups of at least ten (10) participants.
5. Recreational Services start times are non-negotiable, Guides cannot extend your tour should you be late.
6. Should any member of the group require special assistance, this must be organised at least 14 days prior with Buller Holidays or RockWire Mt Buller Pty. Ltd.
7. All Guides employed by the Recreational Service ‘Rockwire Mt Buller’, possess a valid working with Children’s Check.
8. Group’s teachers can participate FOC at a ratio of 1:10 for participants.
9. All recreational services are non-transferable and cannot be resold.
10. Recreational Services must be collected from the Altitude/Buller Sports location or office by a teacher or assistant accompanying the group. Recreational Services will not be signed out to individuals.
11. I, as the person and/or party responsible for organising the school group’s trip, acknowledge and agree that the Recreational Services provided are all services provided by the Supplier associated with the use of the snow slopes and the mountain for recreational activities, including but not limited to skiing, snowboarding, tobogganing, mountain biking, Via Ferrata, rock-climbing, hiking and sightseeing. The Recreational Services include, but are not limited to, the provision and operation of Ski Lifts, snowmaking, snow slope design, construction, maintenance and grooming, hazard assessment and mitigation, construction and maintenance of mountain bike trails and rock-climbing routes, skiing and snowboarding lessons, equipment rental, and the operation of the ski patrol. These are dangerous recreational activities within the meaning of the Wrongs Act 1958 (Vic).
12. I, on behalf of the person/school/company/business responsible for organising the group’s trip undertake the responsibility to notify all parties impacted by the Rockwire group waiver (including any applicable risk warnings).
13. It is a requirement that all participants wear accredited harnesses, helmets and all additional Via Ferrata Equipment issued by the Supplier at all times.
14. These Conditions are to be governed by and construed first in accordance with the laws of the Commonwealth of Australia and secondly in accordance with the laws of the State of Victoria. If there is any inconsistency, the laws of the Commonwealth prevail. The courts of Victoria have exclusive jurisdiction. If any provision is determined to be void, illegal, invalid or otherwise unenforceable it shall be deemed to be deleted and the remaining provisions shall remain and continue to be valid, binding and enforceable;
15. I agree and confirm that my business/company/school has in place, and will retain for the 2024/2025 Green Season, a contract of insurance with a reputable insurance company or underwriter which will indemnify it for all and any liability that it or I may at any time have to RockWire Mt Buller Pty. Ltd. for breach of any term of the agreement as set out in this letter. Upon request I will provide RockWire Mt Buller Pty. Ltd. with a Certificate of Insurance confirming the existence of such an insurance contract.
